Yes, unless there was an order entered in the prior case restricting your ability to re-file. Such orders are rare and usually stem from multiple filings, fraud or bad faith on behalf of the debtor. However, the ability to receive a discharge is restricted by the amount of time between filings. For example, a party can only receive a discharge in a Chapter 7 case if there has been a full 8 years between filings (time runs from filing date to filing date).
